Impossible to Get a Search Warrant in California For a Blood Draw? Not So Says A Long Beach DUI Attorney

Recently, in a United States Supreme Court case, the government argued that obtaining a search warrant for a blood draw of a DUI suspect was difficult to do withing the context of a drunk driving arrest.  However, in California a system is alreadfy in place to get a telephonic search warrant.  As an alternative to written affidavits California Penal Code 1526(b)(1) permits sworn oral statements that are subsequently transcribed. For example, the affiant may phone the magistrate, state probable cause, and obtain the magistrate’s verbal authorization to sign the latter’s name to the warrant under the Penal Code in the state. The resulting warrant is the so-called telephonic (or, more accurately, telephonically authorized) search warrant. The expression “telephonic search warrant” can give rise to the erroneous impression that the warrant itself is oral. All search warrants must be in writing. The only thing different about a telephonic warrant is that the affiant signs the magistrate’s name to a duplicate original search warrant.  This makes sense and allows for adequate protections in the remote context.

According to one Long Beach DUI Attorney, the CA Judges Benchguide offers detailed instructions to Judges on duty after hours and on weekends when the Courts are closed.  The statutes do not mention statements by the affiant over the telephone, but have been interpreted to permit them. The procedure is constitutional. No special circumstances need be shown for issuing a telephonic warrant.  Indeed, in Los Angeles County all telephonic search warrants are obtained through a District Attorney Command Post. Under this process, if the deputy DA believes the case is appropriate for a telephonic search warrant after talking with the affiant, the command post investigator sets up a conference call between the affiant, deputy DA, judge, and investigator (who runs the recording equipment). Courts may have different procedures. The following is an example adapted from various counties.  The affiant’s statement must be recorded. The judge should be sure to record the conversation, check that the equipment is switched on and operating. If the affiant is recording the conversation, the judge should ask whether the recording equipment is turned on.  These procedures ensue an adequate record on review.  There can be no doubt that the implementation of the current procedures can be re-tooled to allow for blood draw search warrants for DUI suspects on the roadside or at the police station after arrest.

Is a Citizen's Arrest in California for DUI Legal?

In California, a police officer is not the only individual that can effectuate an arrest for a DUI.  A citizen’s arrest for DUI is proper when based on the citizen’s observation that the defendant was driving under the influence; in so doing, the citizen may delegate to a peace officer the act of taking the defendant into physical custody. This authority is vested in CA Penal Code 837.   For example, in one recent case, the Court ruled a citizen may make arrest for misdemeanor committed in his or her presence Johanson v Department of Motor Vehicles (1995) 36 CA4th 1209,  Also in another appellate court case, the Justices opined, a parking lot attendant who, observed defendant trying to exit parking facility by driving wrong way and into facility’s entrance gate, called 911 and a police officer and reported his observations to officer who made arrest,  and in another published California DUI case, the Court found, an inspector of Department of Food and Agriculture who stopped defendant’s vehicle at inspection station, observed defendant was intoxicated and reported observations to highway patrol officer who arrested defendant.  The bottom line is that a suspected drunk driver cannot escape liability because the person making the contact was not law enforcement.

Hacking And Cracking: What's The Difference?


In the field of cyber security, there are two distinct groups of individuals, hackers and crackers. A person will ultimately be classified as either one or the other depending on their particular intentions; however there are different skill sets and subgroups typically associated with each title. To help differentiate, below is a breakdown of hackers, crackers and everything in between so you can gain a better idea of who is responsible when a cyber security breach occurs.

Hackers:

The term “hacker” typically refers to individuals who seek to fully understand how computers and network systems function in order to gain in-depth knowledge and perform a precise exploit of vulnerabilities.

These experts in computer security tend to have non-malicious intentions and thus have become colloquially known as “white hat” hackers. White hat hackers engage in ethical hacking, which consists of lawfully breaking into systems for the purpose of exposing security flaws. They either seek to improve the protection of their own security systems or they are hired by organizations to perform this service. In order to do this, the hackers will initiate assessments of the company’s security system by attempting to penetrate it. If the hacker is successful during penetration tests, they are generally responsible for reporting the issue and developing a solution to prevent the same kind of security breach from occurring maliciously in the future. Companies often hire individuals to test for these vulnerabilities instead of leaving possible holes in their security systems open to attack by malicious hackers, commonly referred to as “crackers.”

Crackers:

The title of a “cracker” has gained much controversy over the past few years in regards to its malicious connotation and the reputation these individuals have gained throughout the cyber security community.

Hackers often make the argument that crackers are less knowledgeable of computer systems and lack originality in their work, which is true to an extent. Crackers are motivated solely by personal gain and are not concerned with learning the ins and outs of computer systems as much as their counterparts. Additionally, the fact of the matter is that crackers do not need to follow ethical guidelines; they simply need to exploit the system. The primary goal of a cracker is either to obtain valuable information that will lead to personal gain or to cause mischief for organizations simply because they are capable of it. Regardless of their motives, the malicious intention of these crackers has led to them being labeled as computer criminals, or “black hat” hackers. They may choose their victims randomly or target specific organizations based on profitability and other interests, but the end goal is always for their personal gain never as an ethical profession. These crackers are often caught for their malicious acts because they are not cautious or mindful of the protections that have been put in place by a business’ white hat hackers. Businesses with secure networks will hire ethical hackers to establish a honeypot, which is essentially a trap used to detect and counteract unauthorized breaches by the black hat community.

Grey Hat Hacking:

The term “grey hat” is used as a combination of white hat and black hat because it refers to hackers that engage in both hacking and cracking. While they may break into computer systems for the purpose of making a profit, their intentions are not entirely malicious. The grey hat hacker may have to perform illegal actions in order to test a system for vulnerabilities and make the necessary improvements. A possible scenario for a grey hat hacker could be breaching the security system of a company and then notifying them of the vulnerability in hopes of receiving a payment to improve the system. These tactics are seen as questionable in the hacking community, but in the end they result in a positive outcome for the hacker and improved security measures for the involved organization.

Are Field Sobriety Tests Accurate?

In today’s world, which is run by technology, it is almost required for all businesses to have some sort of online presence. This could be a website, a strong social media following, or simply strong customer service through an email/newsletter system. What is important is that each entity chooses the path that is right for them; the mistake here would be trying to force a business into social media fame. Some types of products and services simply aren’t cut out for that method of exposure. This does not mean that just because your company or product may not be the next Facebook success story that it is impossible to hold a considerable share of the market. It only means that you must go about building your brand in a different manner, this is where LinkedIn rules over the others. Building Your Brand Online

Improving online rankings of any digital asset: web pages, images, videos, etc., has taken on a different direction thanks to Google's latest update which is having an impact on other leading search engines as well. How can you continue to optimize your assets if you've been impacted by these latest optimization changes? The good news is that search results can still be improved.  However, the methods to optimize your site and brand must change to leverage the recent emphasis of an updated Google algorithm.

What no longer works

The place I like to start when it comes to optimization is with traditional methods of optimization.  In the past you could hire a company based in India and pay them pennies on the dollar to build thousands of links into your website from a variety of sources.  Whether you successfully optimized your website from an on-page perspective first or not didn’t really matter.  All you needed was a series of inbound links including your target keyword phrase and you’d find success.

Then things slowly began to change.  Google made a couple of updates and suddenly stuffing your inbound links with nothing but keywords became less effective.  After the initial Penguin update, incoming links from many sites became much less valuable and recently became a way to penalize websites for gaming the system.  

Where that leaves us today is with a list of techniques that once were highly effective now proving to be highly damaging to new and well established websites.  It would have been enough if Google simply discredited negative listings but now, unfortunately, they took things a step further and have begun to penalize sites for trying to arbitrarily building links.

What’s working now

The next question you are likely asking yourself is if all of those old optimization strategies don’t work, what’s working now.  And the answer is not necessarily black and white.  In fact the newest strategies combine some old methods with new ones.  As an example, instead of starting from scratch, you need to leverage existing web pages found on other domains for branded search. When users search for the company being referred to, the page renders in search results.  Because the content of this page is positive, it makes sense for the business to link to it from their site and promote via their social media accounts.

Another example is leveraging your own social media and digital assets that reside on authoritative websites. It will also show in branded search results and the content can be manipulated by the company it serves.

This is also true of sites like Facebook, LinkedIn, and Google+.  Your initial goal should always be to first identify the sites and digital assets that can be promoted but don’t necessarily reside on your domain.

Promoting your own web property

Okay, you’re probably saying, “This is great but I want my website to rank for a select number of keywords.”  Improving the ranking of your site is possible considering newer methods of optimization.  The best place to start is with your own website.  Is it fully optimized?  Are there any technical errors?  Duplicate content?  Easy navigation? Original content?


Focus on your site first from a technical perspective.  If the foundation is strong, you’ll have a much better opportunity to fully optimize the site and begin appearing in search results for your primary keywords. This leads to the second step in optimization – content development.

It used to be that you could create a website and let it be.  Most optimization work was done off site and Google didn’t give much weight to website updates.  Well, today, that just isn’t the case.  Making regular website updates is essential to search engine optimization success.  And updates need to come in the form of regular, original, shareable content.

Natural link creation

This has all been the result of Google’s goal of making organic search more natural and truly organic.  Think about it this way.  If you have valuable content on your site, other people are going to link to it, talk about it, and share it with their networks.  Thanks to social media this is easier than ever.  The best way to being tapping into this source of optimization is a comprehensive content development strategy.

Once content is developed, consider how best to share and promote that content.  As always, slow and steady wins the race.  Don’t expect to generate great content, build a massive list of followers, and see your rankings skyrocket.  To Google that would look suspicious and to you it should seem unrealistic.  Impacting search engine results is a marathon that begins on solid content principles.

Search engine optimization if dependent more on social media, content sharing, and a diversity of digital assets than ever before.  Start with content development and move towards natural link building (this may include social channels, blogging, press releases, etc.) that makes sense in the eyes of Google.  Over time you’ll see results.
